Sex in Sweden to require proof of explicit consent Silent consent no longer enough.

As of July 2018, Sweden’s sexual consent policy will be changed from implicit consent, or “No Means No,” to implicit rape, where even if both partners eagerly-but-silently engage, one could bring rape charges against the other.

One may assume the law doesn’t apply to those that cannot speak the language.

According to Die Welt, the new laws, which are scheduled to go into effect in July 2018, will require those involved to provide the consent before they engage in sexual relations. If either partner fails to provide the verbal or written consent, they could be subjected to rape charges.

Sweden’s current consent laws state that as long as neither partner says “no” to sexual contact, the actions would be deemed consensual. The only exception to this case would be if either partner were extremely intoxicated.

Although the new legislation says verbal consent before sexual relations is sufficient, written consent is advised in case of a potential rape allegation.

“The message is simple. You need to ask the person you want to have sex with whether she wants it. If you are unsure, you have to leave it. Sex must be voluntary.” said Social Democratic Prime Minister Stefan Löfven.

According to Breitbart, the new law was inspired by the #MeToo campaign.

The Swedish media and many of the country’s politicians have mostly supported the new law.

Columnist Staffan Heimerson was one of the only voices of opposition, and was soon fired from his position at the newspaper Aftonbladet after calling the new law a “witch-hunt” that was similar to “Stalin’s purges.”

The new legislation could be seen as an effort to crack down on the brutal rapes occurring throughout the country.

According to the Gatestone Institute, Sweden is “number two on the list of rape countries, surpassed only by Lesotho in Southern Africa.”

Some prominent figures in Sweden have linked the rape epidemic with the large influx of migrants.

“When will you journalists realize that it is deeply rooted in Islam’s culture to rape and brutalize women who refuse to comply with Islamic teachings. There is a strong connection between rapes in Sweden and the number of immigrants from MENA-countries [Middle East and North Africa],” said Michael Hess, a local politician from Sweden Democrat Party wrote in 2014 before being charged with “denigration of ethnic groups,” a crime in the country.

Although there is a clear correlation between the number of rapes and the number of migrants, the Swedish government has refused to release statistics on the subject.

“The common denominator of those who commit these crimes is that they are men,” said Justice Minister Morgan Johansson. “It seems that the Moderates [political party] are pulling out of talking about the men’s role in this and instead just want to blame the immigrants.”

“Sweden’s earlier figures and numerous international studies all show much the same thing. Minority groups are often overrepresented in crime statistics, but when controlling for socioeconomic factors this [the overrepresentation of minority groups] disappears almost entirely,” Johansson added.

What we need is for consent to on-going sexual activity to be given at a public ceremony, in front of witnesses, and the consent to be signed by both the couple and the witnesses, and the document stored in a central registry.

Might be a good idea, but consider the logical extension of it. Contracts are used when trust does not exist, or when the stakes are high. They also require that both parties agree that there is a neutral authority available to enforce the contract. Such neutral authority does not exist in Sweden.
Interpersonal relationships, when they exist, are based on trust. This proposed process defines the absence of trust.
Absent trust or relationship, such contracts would likely be relegated to arrangements for commercial sex, for those people civilized enough to bother with such contracts.
In Sweden, most of the rapes are overtly violent, with a significant number being gang rapes. Most of the rapists there are “immigrant” muslims, and / or third-world savages, who have no tradition of tespest for others, and who specifically rejecy the civil laws of the nations they invade.
In short, your proposal would not solve the problem Sweden has with rape, but it would promote further breakdown of the already fragile trust between men and women.
