Basing it on sex is not arbitrary. You might disagree with the reasoning but that doesn't mean it's done basically just because the doctor felt like it.

It's as real as any other biological classification, which is to say it's a grouping by common traits. While there are cases of intersex people they're a vanishingly small minority so by and large doing things by sex is sensible. We can debate the reality of grouping people into male and female all day but what gets people shoved into each group is certainly is not arbitrary.
Arbitrary implies a doctor can look at a baby boy and call him a girl just because he felt like it. Go see what happens if that is tried.
