Even absent ensoulment, however, the embryo deserves legal protection, just as the law protects American Bald Eagle eggs, although there's no question of any ensoulment there -- it's just a matter of seeing the obvious connection between the egg and the eagle.
And if the DNA is genetically engineered to be different? At what point does the soul become washed clean of sin? If your whole personality and memories and body were changed, then does your soul persist or do you gain a new soul? When does the first soul die? What the fuck is a soul anyway?

The claim is that if federal law protects eagle eggs - and indeed it does - it could, by similar logic, deign to protect a unique human life in the woman, regardless of the issue of ensoulment, regardless even of whether human beings have souls (nobody is claiming that eagles have souls, much less eagle eggs).
